General Conditions

ORGANIZATION / PURPOSE
These general contractual conditions are intended to establish the terms and conditions governing the provision of travel services organized by CAPITALTUR - Viagens e Turismo, Lda, headquartered at Avenida Combatentes da Guerra, 48 - store 1, in Leiria , with a fully paid-in capital of € 110,000, registered at the Commercial Registry of Leiria, No. 2280, and corporate entity 501 777 741, agency with RNAVT No. 1944.
The terms contained in any particular conditions, if any, prevail over the provisions of these general conditions.

REGISTRATION / PAYMENT

At the time of registration the customer must deposit 30% of the price of the trip, and the remaining 70% will be settled up to 21 days before departure. If the registration takes place 21 days or less from the date of departure, the total price of the trip must be paid at the time of registration, which is conditional upon obtaining the suppliers' confirmation of the reservations for all travel services. CAPITALTUR reserves the right to cancel any registration whose payment has not been made under the conditions mentioned above. Private payment conditions: In exceptional situations conditioned by suppliers and / or times of the year, full payment may be required at the time of registration or confirmation of travel services.

RESERVATION EXPENSES

For each reservation, the service charge of € 30 (non-refundable) will be charged.

CHANGES
If it is possible, whenever a customer, registered for a particular trip wishes to change his registration for another trip or to the same departure date, or make changes to data (names, room type, place of departure), you must pay a fee, such as € 20 change charge for each (non-refundable) change plus any charges that the change entails. If it is not possible to make the change, the customer will be subject to the expenses and charges set forth in the item "Withdrawals".

APPLICATION FOR REGISTRATION
The customer can assign his / her registration, being replaced by another person who fulfills all the conditions required for the trip, provided that he / she informs the selling agency at least 21 days in advance and that the different providers of services included in the trip accept the replacement. The transfer of registration jointly and severally blames the transferor and the transferee for the payment of the price of the trip and for the additional charges incurred.

BAGGAGE

1) The agency is responsible for baggage under the legal terms;
2) The customer has an obligation to complain to the entity providing the services at the time of subtraction, deterioration or destruction of luggage.
3) In the international transport, in case of damage in the luggage, the complaint must be made in writing to the carrier immediately after the verification of the damage, and a maximum of 7 days from its delivery. In case of a delay in the delivery of the luggage, the claim must be made within 21 days from the date of delivery.
4) The presentation of such a complaint will be an essential basis for triggering the responsibility of Capitaltur over the entity providing the service.
(5) The liability of the agency shall be limited to the maximum amount due to service providers under the Montreal Convention of 28 May 1999 on International Carriage by Air.

CHANGES

Whenever there are other reasons that justify it, the organizing agency may change the order of the routes, modify the departure times or substitute any of the hotels provided by others of similar category. If unforeseen circumstances make it necessary to suspend any travel, customers will always be entitled to reimbursement of the amounts paid.

CHANGE TO PRICE
The prices shown in the program are based on the costs of the services and exchange rates prevailing at the time of printing of this program and are subject to changes resulting from changes in transport or fuel costs, duties, taxes, exchange rate fluctuations . Whenever there is a change in the price of the trip, the customer will be informed immediately and invited to accept the increase verified or cancel its registration in the same terms and conditions as those provided for under the heading "Impossibility of Greeting".

REFUNDS
Once the trip is started, no refund for unused customer services is due. Failure to provide services provided in the travel program for causes not attributable to the organizing agency, and if substitution is not possible with other equivalent, gives the customer the right to be reimbursed for the difference between the price of the services provided and those actually provided.

CLAIMS
They can only be considered provided that they are submitted in writing and within a period not exceeding 20 days after the end of the provision of services. They can only be accepted as long as they have been participated to the suppliers of the services (carriers, hotels, local agents, etc.) during the course of the trip or stay, requiring them the corresponding documents proving the occurrence.

IMPOSSIBILITY OF COMPLIANCE
If, for reasons not attributable to the organizing agency, it is unable to carry out an essential part of the program or if it is forced to make the trip feasible, to add some service or to increase the duration of another already planned, including accommodation, the customer is entitled to withdraw from it, being reimbursed of all sums paid or, alternatively, accepting a possible change and price change. If the said events are not attributable to the organizing agency, they determine the cancellation of the trip, the client may also choose to participate in another organized trip, of equivalent price. If the arranged trip proposed in substitution is of lower price, the customer will be refunded of the respective difference. In no case shall the organizing agency be liable for non-compliance or deficient compliance if it is due to situations of force majeure or fortuitous event, caused by abnormal and unforeseeable circumstances, unrelated to the person invoking them, the consequences of which could not have been be avoided despite all the steps taken, as well as in cases where the non-provision of services has been determined by the supervening of legal, regulatory or contractual conditions of responsibility of suppliers directly or indirectly involved in the same, on which the agency could exercise the right of return. In the cases not included in the previous point, the non-provision of services provided in the travel program for causes not attributable to the organizing agency, and if it is not possible to replace them with equivalent services, gives the customer the right to be reimbursed for the difference between the price of the services provided and those actually provided.

CANCELLATION OF THE PROGRAM BY THE AGENCY

The agency reserves the right to cancel the package if the number of participants is less than the minimum required. In these cases, the client will be informed in writing of the cancellation within 8 days in advance, and in this case, there will be no civil liability of the agency for termination.

DOCUMENTATION

The client must have in good order all personal or family documents (passport, citizen's card, identity card, authorizations for minors, visas, certificates of vaccines and others that may be required). Banknotes or birth seats are not valid as a travel document. The organizing agency declines any responsibility for refusing the granting of visas, or refusing permission to enter the client in a foreign country; in these cases the conditions established for the cancellation of the trip are applied, being still of the account of the client any and all costs that the situation entails. When traveling in the European Union, clients must carry their European Health Insurance Card to obtain medical assistance.
Customers who are foreign citizens must have the necessary documentation (passport, visa, residence permit, etc.) to travel or transit within the European Union according to their nationality. For travel in whole or in part outside the European Union, visas or other special documentation may be required. Always consult the Embassy or Consulate of the destination countries of your trip.

TRAVEL DOCUMENTS
The travel documents (airline tickets and vouchers) issued by Capitaltur are subject to contractual conditions of group travel and therefore can not be issued well in advance of the date of departure. Under exceptional conditions imposed by suppliers, emissions may have to be anticipated.

MEALS INCLUDED
Meals included, whether in restaurants or hotels, will be served to the group on a fixed schedule and with the same menu for all participants, and there can be no changes.

TRIPLE ROOMS
Most hotels in this brochure do not have triple rooms. When accepted by the hotels the accommodation of 3 people in the same room, will be realized in a double room with extra bed, which may not be identical in quality and comfort.

ARRIVAL AND DEPARTURE HOURS

The arrival and departure times in each city are indicated in the local time of the respective country and according to the schedules indicated by the transport companies at the time of printing of this program and therefore are subject to change. For trips made totally or partially by bus, the times indicated are approximate. Delays resulting from technical or other reasons related to the means of transport, transport undertakings or natural causes are also to be noted in all modes of transport.

DESISTENCES
If the client or any of his or her escorts withdraws from the trip, regardless of the reason for the cancellation and based on the total effective price of the trip, it entails the payment of a contract with airlines, cruise companies, hotels and other service providers. per person of the following funds:
- up to 60 days before departure: 30 euros of management expenses
- from 59 to less than 21 days or no show at the start: to be defined on each trip

RESPONSIBILITY
The liability of Capitaltur, arising out of the obligations assumed, is guaranteed by civil liability insurance in the Insurance Company Zurich, with the policy number 004777396, in the amount of Eur: € 75,000.00 and by the Travel Guarantee Fund and Turismo do Turismo de Portugal.

VAT

The aforementioned prices already reflect the value added tax (VAT) at the current rate.

AVIATION FEES
The airport, security, and fuel rates shown in this brochure were calculated at the time of printing. Due to constant changes, they will be subject to reconfirmation of the price up to 21 days before the date of departure.

HARBOR DUES
